Or actually jumping on the wrong issue.

Allwinner is not the problem, they don't really care and as you note
have very little stand in defending themselves if they all of a sudden
would claim the code they shipped to their customers for Linux kernel is
their secret.

The problem is the simple fact that the code is not licensed in GPL
compatible terms which means it can not be linked to the kernel without
ciolating the license of the rest of the kernel. And further that there
is exactly zero probability of mainlining any of it for the same
reasons.
